A New Inner Ring of Protection

An exciting new dimension in lawsuit deterrence is the Workplace Integrity Package (WIP) which provides employers with a new inner ring of protection against workplace lawsuits. With the WIP, employees and business associates must try to resolve differences informally and, if necessary, by independent mediation and and ultimately binding arbitration.

Resolve Disputes in a Better Way

The Workplace Integrity Package, in effect, levels the playing field for the resolution of workplace disputes. In the past, employers were greatly disadvantaged in a costly and time-consuming legal process that favored workers who could sue at any time for any reason -- bogus or not -- without financial risk. With the Workplace Integrity Package, both parties have exactly the same obligations, risks and rights.

In addition to the WIP’s Alternative Dispute Resolution Policy, the Package includes a Confidentiality and Non-Disclosure Policy that helps safeguard the employer’s private and proprietary information from unauthorized disclosure by employees or business associates through the use of binding arbitration instead of costly litigation. This policy also provides for injunctive relief from further damaging disclosures pending the outcome of binding arbitration.

An outgrowth of the U.S. Supreme Court’s decision in that binding arbitration can be a condition of employment, the Workplace Integrity Package has been reviewed by the independent American Arbitration Association, which has agreed to administer the mediation and/or arbitration phases of the Policies.

This new package of employment policies works best as part of an overall asset protection plan. Should arbitration fail to resolve a workplace dispute, your asset protection plan kicks in to protect your assets and minimize the economic incentive to sue -- which is a significant deterrent against lawsuits by employees and other potential plaintiffs.

The WIP can be used by any employer, and is easy to add to your existing employee handbook.
